1. Introduction​

These General Terms and Conditions of Use (GTU) govern the use of CartoExplorer applications (hereinafter "the Applications") and the associated website https://www.cartoexplorer.com (hereinafter "the Website"), (hereinafter collectively referred to as the "Ecosystem"), operated by CartoExplorer (hereinafter "the Publisher"). By accessing one of the Applications or the Website, the User fully and unreservedly accepts these GTU.

If you do not agree to these terms, please do not use our Ecosystem.

3. Access to Services​

3.1 Access Conditions​

The Applications and the Website are accessible free of charge. Subscriptions offered by the Publisher allow to unlock some features.

3.2 General Terms and Conditions of Sale​

The purchase of these subscriptions is subject to CartoExplorer's General Terms and Conditions of Sale (GTCS), available on the website https://www.cartoexplorer.com. Before proceeding with a subscription purchase, the User must carefully read and accept the GTCS.

The GTCS define in particular the terms and conditions of ordering, payment, renewal and termination of subscriptions, as well as the rights and obligations of the Publisher and the User.

3.3 Availability​

The Publisher makes every effort to ensure the availability of the Services. However, CartoExplorer declines all responsibility if access to its Ecosystem is temporarily suspended for external reasons, maintenance or in case of force majeure.

4. Use of Services​

4.1 User Obligations​

The User agrees to:

  • Not use the Ecostystem for illegal or immoral purposes.
  • Not infringe the intellectual property rights of the Publisher or third parties.
  • Provide accurate information when registering (if applicable).

4.2 Restrictions​

It is strictly forbidden to:

  • Attempt to gain unauthorized access to parts of the Ecosystem.
  • Extract, copy or reproduce cartographic data without prior authorization from the Publisher.

5. Intellectual Property​

All content (texts, images, maps, logos, graphics, code, etc.) present on the Applications and the Website is protected by intellectual property laws. Any unauthorized reproduction, representation or exploitation of the content is strictly prohibited.

6. Personal Data​

7. Responsibility​

CartoExplorer cannot be held responsible for direct or indirect damage resulting from the use of the Ecosystem, in particular in the event of error, omission, service interruption or technical problem.

The User is solely responsible for their safety during their practice. The information provided by the Ecosystem cannot replace common sense and basic safety rules.

8. Warning​

8.1 Dangers inherent in outdoor activities​

Practicing an outdoor activity is potentially dangerous and can sometimes lead to injury or even death. The User of the Applications is entirely responsible for his activity and must know how to anticipate potential dangers. He must :

  • Know how to assess his physical capacity. 
  • Keep informed of the weather conditions, particularly local ones, and the practicability of the area in which he wishes to move.

CartoExplorer cannot be held responsible in any way for the failure of the User to achieve his objectives, or for any other incident, accident, injury or death occurring in the field.

The User is solely responsible for the interpretation and use of the information provided by the Applications to safely enjoy his outing.

8.2 Insurance​

CartoExplorer reminds that personal accident insurance is strongly recommended for the practice of activities involving bodily risk. This insurance must be taken out personally by the User with an insurer.

The User is also advised to inquire about the conditions of rescue and repatriation in force in the sector, the country where he decides to practice his activity.

9. Modification of the GTU​

The Publisher reserves the right to modify these GTU at any time. The modifications come into effect upon their publication on the Website or the Application. The User is invited to consult the GTU regularly.

10. Applicable Law and Jurisdiction​

These GTU are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the French courts.

IGN licence terms​

CartoExplorer offers include Data and / or Geoservices for which the IGN owns the intellectual property rights or has the necessary agreement of the rights holders.

The license granted to the user of IGN Data or Geoservices does not result in any transfer of ownership of this data.

The use of these Data and / or IGN Geoservices is strictly limited to the End User Private Use.

The IGN Data and / or Geoservices must not be extracted from or used independently of the Offer.

Reproduction for distribution to third parties or the marketing of graphic output is prohibited in any form or by any means whatsoever.

Any reproduction resulting from data or Géoservices IGN must include the following mentions :
