1. Introduction

These Terms and Conditions of Sale (hereinafter the "T&Cs") are intended to define the terms and conditions applicable to the subscription, access, and use of services offered by the company CartoExplorer (hereinafter the "Provider") on its website https://www.cartoexplorer.com (hereinafter the "Website") and its applications (hereinafter the "Applications"), by any user or customer (hereinafter the "Customer"), whether a professional or a consumer. They apply to all orders placed via the Website https://www.cartoexplorer.com.

These T&Cs are accessible at all times on the Website and Applications and shall prevail, where applicable, over any other version or conflicting document.

2. Purpose

The Application offers paid subscriptions granting access to content and services such as maps and features.

The characteristics of all available subscriptions are accessible on the "Subscriptions" page of the website https://www.cartoexplorer.com. The Customer must review them prior to any purchase process.

Validation of a subscription order by the Customer constitutes full and unreserved acceptance of these Terms and Conditions of Sale.

The Customer declares to have read and accepted these T&Cs by ticking the appropriate checkbox when confirming an online order.

These conditions apply to the exclusion of all others, particularly those applicable to other distribution channels.

By placing an order, the Customer declares that they have the legal capacity to enter into contracts and purchase the Services offered on the Website.

3. Subscriptions

Upon account creation, the Customer is granted a 10-day free trial giving access to all features and content of the Application.

At the end of this period, continued access requires subscription to one of the annual plans offered. CartoExplorer offers the following annual subscription services:

  • Service levels unlocking features
  • Access to specific map layers

The Customer may choose from various annual subscription plans, the prices of which are indicated on our website.

Regardless of the selected subscription plan, it begins upon confirmation of the order by the Provider and receipt of payment, and runs for a period of 365 days.

Subscriptions are automatically renewed at the end of each term, unless deactivated by the Customer before the renewal date. In accordance with Article L215-1 of the French Consumer Code, consumer Customers will be informed by email of the possibility to cancel the subscription, no earlier than three months and no later than one month before the automatic renewal date.

4. Pricing

The Services (subscriptions) provided by the Provider are offered at the rates in effect on the Website at the time of order confirmation. Prices are expressed in Euros, including VAT.

These rates take into account any applicable discounts offered by the Provider, as specified on the Website.

Prices are firm and non-revisable during their validity period, as stated on the Website. Outside of this period, the Provider reserves the right to modify prices at any time.

The total purchase amount is due at the time of order.

An invoice is issued by the Provider upon delivery of the ordered Services, and is available in the Customer’s account area on the Website.

5. Payment

Payment is due in full at the time of order placement, using secure payment methods:

  • Bank cards: CB, Visa, MasterCard
  • PayPal

CartoExplorer’s payment service takes data protection seriously. Key security measures include:

  • PCI DSS certification
  • Data encryption
  • HTTPS and HSTS secure communication protocols
  • Proactive monitoring
  • Compliance with data protection laws such as GDPR
  • Strict access control
  • Regular audits

Banking information is stored solely by the payment provider for as long as needed to process payments, manage subscriptions, and meet legal obligations.

The Provider is not obligated to deliver the ordered Services if payment has not been made in full under the above conditions.

Payments will only be considered final once the Provider has actually received the amounts due.

In the event of non-compliance with the above payment terms, the Provider reserves the right to suspend or cancel service delivery and/or suspend its obligations.

No additional fees will be applied.

6. Service Delivery

A subscription purchased by the Customer becomes active upon final confirmation of the order and is valid for 365 days.

The Provider commits to making its best efforts to deliver the Services, under a best-effort obligation and within the defined timeframe.

7. Right of Withdrawal

In accordance with the law, the Customer has a right of withdrawal within 14 days from the subscription date, with a full refund of any amounts paid.

To exercise this right, the Customer must send a request by email to contact@cartoexplorer.fr within the time limit. The request must include the account email, order number, and subscription date.

Once the request is validated by the Provider, the associated subscription will be automatically terminated.

8. Cancellation

The Customer may cancel their subscription at any time by logging into their account on https://www.cartoexplorer.com. Cancellation takes effect at the end of the current subscription period.

9. Account Suspension or Termination by the Provider

The Provider reserves the right to temporarily or permanently suspend access to the Services, without compensation or refund, in the event of serious breaches of these T&Cs, such as:

  • Fraudulent or improper use of the Application or Subscriptions
  • Attempts to bypass security measures or illegally copy content
  • Unresolved payment incidents within a reasonable timeframe
  • Behavior infringing upon the rights of the Provider or third parties

The Customer will be notified by email at the address associated with their account. Unless the breach is serious or repeated, the Customer will have the opportunity to respond before any permanent account termination.

10. Liability

CartoExplorer uses reasonable efforts to ensure the availability and proper functioning of its Applications and Subscriptions. However, it cannot be held liable in the following cases:

  • Service interruptions due to maintenance or technical issues beyond its control
  • Access difficulties due to network or user device problems
  • Errors or omissions in the information provided, despite best efforts to keep it up to date
  • Improper use of the Application or Subscriptions by the Customer
  • Indirect damages such as data loss, loss of profits, or missed opportunities

CartoExplorer’s liability shall not exceed the amount paid by the Customer for the affected subscription. The Provider is not liable for failure to perform due to force majeure (an external, irresistible, and unforeseeable event).

11. Intellectual Property

The CartoExplorer Applications, the website https://www.cartoexplorer.com, and their user interfaces are the property of the Provider and protected under French and international intellectual property laws. Any total or partial reproduction is strictly prohibited and may constitute infringement.

The Provider retains all intellectual property rights over photographs, presentations, studies, drawings, models, prototypes, etc., created for the purpose of delivering services, including at the Customer’s request.

The Customer is prohibited from reproducing or exploiting such materials without the Provider’s prior written authorization, which may be subject to a fee.

12. Personal Data

In accordance with the European Regulation 2016/679 (GDPR) and French Law No. 2018-493 of June 20, 2018, personal data requested from the Customer is necessary for processing orders and generating invoices. Such data may be shared with the Provider’s partners responsible for execution, processing, management, and payment of orders.

Customers have the right to access, modify, correct, and oppose their personal data, in accordance with applicable national and European regulations.

These rights can be exercised under the conditions outlined on the Website.

13. Governing Law and Jurisdiction

These Terms and Conditions of Sale and related operations are governed by French law.

These T&Cs are written in French. In the event of a translation, only the French version shall prevail in case of dispute.

Any disputes that may arise in connection with the application, interpretation, performance, or termination of these T&Cs and which cannot be resolved amicably shall be submitted to the competent courts in accordance with common law.
